SERENGETI PRIVACY POLICY

This privacy policy ("Policy") explains how personal information is collected, used, and disclosed with respect to your use of our Web site located at www.serengetilaw.com (the "Site") and the Serengeti Tracker service ("Serengeti Service") provided by West Publishing Corporation d/b/a Serengeti Law ("Serengeti", "we" or "us") so you can make an informed decision about using the Serengeti Service. By using the Serengeti Service, you consent to the privacy practices described in this Policy, as may be modified by us from time to time. We reserve the right to change the provisions of this Policy at any time. We will alert you that changes have been made by indicating on the privacy policy the date it was last updated. Your use of the Site and Serengeti Service following the posting of such changes or revised statement shall constitute your consent to any changes in our privacy practices. We encourage you to review this Policy whenever you visit our Site to make sure that you understand how any personal information you provide will be used.

WHAT IS PERSONAL INFORMATION?

As used herein, the term "personal information" means information that specifically identifies an individual (such as a name, address, telephone number, personal e-mail address, legal bar identification number, or other account number), and information about that individual's location or activities, such as information about his or her use of the Site or the Serengeti Service, when directly linked to personally identifiable information. Personal information also includes demographic information such as your job title, employer, geographic area and preferences when such information is linked to other personal information that identifies you. Personal information does not include "aggregate" information, which is data we collect about the use of the Site or about a group or category of products, services or users, from which individual identities or other personal information has been removed. In other words, information about how you use a service may be collected and combined with information about how others use the same service. Aggregate data helps us understand trends and our users' needs so that we can better consider new features or otherwise tailor our Site. This policy in no way restricts or limits our collection, use, or disclosure of aggregate information.

WHAT PERSONAL INFORMATION DO WE COLLECT?

Personal information may be collected in a number of ways when you visit our Site or use the Serengeti Service. We may collect certain information you voluntarily provide to us which may contain personal information. For example, when you request a demonstration of the Serengeti Service, request additional information about our system, complete a survey, or request application support, we may collect personal information, such as your name, address, location, e-mail, phone number, and other contact and demographic information. When you register to set up an account, we collect information about you and your organization. For example, during registration we may collect your name, company name, e-mail address, mailing address and other information relevant to personalizing your account. In addition, from time to time we may collect demographic, contact, survey, or other personal information you provide in connection with your participation in the Serengeti Service.

When you access the Service via our secure Web interface, we collect information about the way you use our services. For example, we collect your Internet Protocols ("IP") address, the type of browser you are using, and the frequency and duration of your visits. We also collect your user ID and password from when you log into the Serengeti Service. We use this information to improve the way that we provide our services, to relay administrative information, and to verify login information. We treat this information as personal information if we combine it with or link it to any of the identifying information mentioned above. Otherwise, it is used in the aggregate only. We may also automatically collect certain information through the use of "session ID cookies," which are small files that are placed on your hard drive to assist us in providing customized services. We use session ID cookies that expire when you close your browser. Although failure to accept cookies will not interfere with the ability to interact with much of our Site, users will need to accept session ID cookies in order to log-in and use the Serengeti Service. The cookies are renewed each time a user uses the Serengeti Service. If we combine cookies with or link them to any of the personally identifying information, we would treat this information as personal information.

Third parties that are corporate users of the Serengeti Service and their law firms may also collect and store data about you on the Serengeti System, but we do not monitor or exercise control over their collection or use of the data entered by users of the Service.

HOW DO WE USE THE PERSONAL INFORMATION WE COLLECT?

In general, we use the personal information that we collect to process your requests or transactions, to provide you with information or services you request, to inform you about other information, events, products or services that we think will be of interest to you, to facilitate and personalize your use of, and our administration and operation of, the Site and the Serengeti Service, and for the purpose for which the information was collected. For example, we may use the information we collect:

  • to send you a welcoming email and to contact you about your use of the Site and the Serengeti Service, such as for administrative purposes or to provide you with customer service;
  • to provide you with all of the services, features, and functionality included within the Serengeti Service, to provide other services, products or information you request and to complete any transactions in connection therewith;
  • to respond to your emails, submissions, comments, requests or complaints;
  • to request feedback and to enable us to develop, customize and improve the Site and our publications, products and services;
  • to conduct research regarding user activities and preferences when visiting the Site or using the Serengeti Service;
  • to contact you about our or a third party's services, products, or offers and for other marketing, informational, product development and promotional purposes; and
  • for the specific purpose for which the information was provided.

Personal information provided online may be linked together or merged with other personal information so that we may better understand your needs and inform you about our products or services and those of our partners. In addition, if we receive information from third parties with whom we have business relationships, we may combine this information with the other personal information we maintain about you. In either case, this Policy governs this information.

SHARING OF PERSONAL INFORMATION

If you choose to provide personally identifying information to us, we may use and disclose it as described in this Privacy Policy (and in any updates to this policy that may be posted to the Site from time to time). We may share personal information with third party vendors, consultants and other service providers (“Service Providers”) who are engaged by or working with us in connection with the operation of the Site and the Serengeti Service and who need access to such information to carry out their work for us. For example, we may engage a third party to assist in routing requests for help, or managing responses to user surveys. We inform our Service Providers that any such information we provide may only be used to carry out their work for us. However, we are not responsible for the actions of such Service Providers, nor are we responsible for any additional information you provide directly to these Service Providers or to other third parties, and we encourage you to become familiar with their practices before disclosing information directly to them. Note that nothing herein restricts the sharing of aggregate information, which may be shared with third parties without your consent.

You understand that when you use the Serengeti Service, certain information you post on the Site or provide through the Serengeti Service may be shared or made available to other users of the Serengeti Service. For example, you may post information such as a document or note that will be made available to other users with whom you have an established relationship through the Serengeti Service. In addition, you understand that use of the Serengeti Service includes the disclosure and display of your personal information to other users and third-party partners. Please be aware, however, that although we endeavor to use commercially reasonable efforts to protect and secure the confidentiality of your personal information, no system or security measure is perfect or impenetrable.

In addition, we may disclose personal information in the good faith belief that we are lawfully authorized or required to do so, or that doing so is reasonably necessary or appropriate to comply with the law or with legal process or authorities, respond to any claims, or to protect the rights, property or safety of Serengeti, our users, our employees or the public, including without limitation to protect Serengeti or our users from fraudulent, abusive, inappropriate or unlawful use of our Site or the Serengeti Service. Information about our users, including personal information, may also be disclosed or transferred as part of, or during negotiations of, any merger, sale of company assets, financing or acquisition or in any other situation where personal information may be transferred as one of the business assets of Serengeti.

WHAT STEPS DO WE TAKE TO PROTECT PERSONAL INFORMATION ONLINE?

We have in place reasonable security measures to protect personal information while it is under our control. In the course of processing the data provided us, Serengeti and its network supplier implement industry standard security features including use of SSL encryption and Virtual Private Networks, firewalls, back-ups, passwords, and audits. Your account information is accessible online only through the use of a password. To protect the confidentiality of personal information, you must keep your password confidential and not disclose it to any other person. Your account cannot be "shared" or used by anyone but you. You are responsible for all uses of our Web site by any person using your password.

Serengeti complies with the U.S.-EU Safe Harbor Framework and the U.S.-Swiss Safe Harbor Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information from European Union member countries and Switzerland. Serengeti has certified that it adheres to the Safe Harbor Privacy Principles of notice, choice, onward transfer, security, data integrity, access, and enforcement. OTHER WEB SITES & PERSONAL INFORMATION

The Site contains links to other Web sites. Any personal information you provide on the linked pages is provided directly to that third party and is subject to that third party's privacy policy. We are not responsible for the content or privacy and security practices and policies of Web sites to which we link. Links from our Web site to third parties or to other sites are provided for your convenience. We encourage you to learn about their privacy and security practices and policies before providing them with personal information.

HOW CAN YOU OPT-OUT OF LISTING YOUR PERSONAL INFORMATION IN THE SERENGETI TRACKER WORLDWIDE DIRECTORY OF FIRMS OR DEACTIVATE YOUR PROFILE?

Serengeti enables Firm users to promote their expertise to prospective clients on Serengeti Tracker in the Tracker Worldwide Directory of Firms. Any information that a Firm user chooses to enter in his or her user profile is saved in the Tracker Worldwide Directory of Firms (a user's "Profile Data"), and is viewable by all Company users in Serengeti Tracker. The Profile Data includes information such as the user's name, street address, email address, phone number, and other information relating to user's legal expertise and experience that each user may choose to enter. A law firm user can access and edit his or her Profile Data that is displayed in the Directory at any time. You may opt-out of listing your name and profile information in the Tracker Worldwide Directory of Firms by logging into the Serengeti Service and editing your User Profile. To do this, click on your name on the left hand side of the screen, then click “Edit User Profile” in the What You Can Do box on the left hand side. Change the Profile Status (i.e. the first field on the profile page) to Partially Deactivated. Then click “Save & Close” in the What You Can Do box on the left hand side.

You may deactivate your profile from the Serengeti Service altogether by logging into the Serengeti Service and editing your User Profile. To do this, click on your name on the left hand side of the screen, then click “Edit User Profile” in the What You Can Do box on the left hand side. Change the Profile Status (i.e. the first field on the profile page) to Deactivated. Then click “Save & Close” in the What You Can Do box on the left hand side. Note that by deactivating your profile, your profile will no longer be listed in the Tracker Worldwide Directory of Firms, you will not be able to bill time to client matters tracked in the Serengeti Service, and will not be able to utilize the Service. Note also that your clients will not be able to add you to matters tracked in the Serengeti Service. Any personal information about you, such as your name, the number hours worked on particular matters, or narrative data that is associated with Firm or Client records such as bills, invoices, billing notes, etc., will remain in the Serengeti System after you deactivate your profile where such information is required or necessary for continuity of your Firm’s recordkeeping obligations.

HOW CAN YOU CORRECT AND UPDATE YOUR PERSONAL INFORMATION OR OBTAIN ADDITIONAL INFORMATION?

You are solely responsible for the accuracy, quality, integrity, legality, reliability, and appropriateness and of all personal information and other data that you provide to Serengeti, post on the Site, or provide to us while using the Serengeti Service.
